I tell my clients all the time that if we sat on our hands and waited for an insurance company to do the right thing, we’d be out of business. The only leverage we have in a personal injury case is the prospect of a jury trial. So, when someone gets hurt and they don’t know whether or not they’re going to be able to work for the rest of their lives, they don’t know if they’re going to be able to provide for their families, moving forward with a personal injury case, moving towards that jury trial, is something that makes an insurance company make a decision. The longer someone waits, the further you are from putting an insurance company in a position where they have to make a decision – “Am I going to settle the case? Am I going to go to trial?”
