If I am injured on a construction site, am I limited to workers compensation benefits?
Hach & Rose, LLP attorney Michael Rose discusses the possibility of benefits available to workers beyond workers compensation when injured on a construction site.
Now, you’re guaranteed workers’ compensation benefits when you’re injured in the course of your employment. So, if you’re injured on a construction site, then you’re certainly entitled to your medical expenses and your portion of your lost wages as a result of that on-the-job injury.
However, in many circumstances, property owners, general contractors, and other negligent third parties on construction sites are responsible, legally responsible, and allow people to bring what’s called a ‘third party claim’. People call our office all the time and say that they contacted a workers’ compensation attorney and they had filed a claim for workers’ compensation benefits, but were never educated on the fact that they had additional rights, which could result in hundreds of thousands, if not millions of dollars in additional compensation, but they were never made aware of.
