New York has special provisions known as “Zone of Danger” rules, under which individuals can pursue compensation if they witness the death or serious injury of an immediate family member. In order to be eligible for this type of claim, a person must be able to show that he or she was aware of the injury or death of an immediate family member AND the person must have also been at risk of suffering harm because of the same incident.
